       Under and by virtue of the power of sale contained in certain Deeds of Trust from Breeden Enterprises, LLC to William C. Rogers, Jr. and W. Charles Rogers, III, Trustees, recorded among the Land Records of Harford County, Maryland as follows: Liber 3595 Folio 459; Liber 3867 Folio 80; Liber 3867 Folio 85; Liber 4342 Folio 227; and pursuant to a Financing Statement and Security Agreement by and between The Learning Garden Child Center, Inc. Debtor to Secured Party recorded among the Financing Records of the Maryland State Department of Assessments & Taxation, default having occurred under the terms thereof and at the request of the party secured thereby, the undersigned Trustees and Attorneys for the Secured Party, will sell at Public Auction, on the premises, the following:

       All that fee simple lot of ground and the improvements thereon, situate and lying in Harford County, State of Maryland, and being more fully described in the above referenced Deeds of Trust and personal property secured in the Financing Statement as follows:

       Being known and designated as Lot 2, as shown on a plat entitled "Final Plat Lots 1 & 2 Lands of Kavah, L.L.C.", which Plat is recorded among the Land Records of Harford County in Plat Book 104, Folio 69. The improvements thereon to be known as 207 Bynum Road.

Property covered under the Financing Statement and Security Agreement: All of the Secured Party's right, title and interest in all tangible and intangible property of the Debtor as listed in the Financing Statement including but not limited to accounts, documents, equipment, farm products, fixtures, general intangibles, receivables, inventory, health care insurance and receivables, etc. (copy may be obtained from offices of the Auctioneers) will be sold with the real property.

       A deposit by certified check or cashier's check of $50,000.00 will be required of the purchaser at time and place of sale. Deposit to be increased to 10% of the purchase price within 24 hours at the offices of the Auctioneer. Balance to be paid in cash at settlement, which shall take place within ten (10) business days following final ratification of the sale by the Circuit Court for Harford County at the offices of the Trustees. If payment of the balance does not take place within the specified time, the deposit shall be forfeited and the property may be resold at the risk and expense of the purchaser. Interest to be charged on the unpaid purchase money, at the rate stated in the Deeds of Trust Note from date of sale to date of settlement. All adjustments as of date of sale. Taxes, and all other public charges and assessments payable on an annual basis, including sanitary and/or metropolitan district charges, if any, to be adjusted for the current year to date of sale and assumed thereafter by the purchaser. The property will be sold in "AS IS" condition, without express or implied warranty as to the nature and description of the improvements as contained herein; and subject to easements, agreements, restrictions or covenants of record affecting same, if any. Purchaser shall be responsible for obtaining physical possession of the property. If the Trustees are unable to convey good and marketable title, the purchaser's sole remedy in law or equity shall be limited to the refund of the deposit.
