       By virtue of a Decree of the Circuit Court for Baltimore City, Case No. 24-O-06-000018 the undersigned Trustee will sell at Public Auction the following:

       All that leasehold parcel of ground situate and lying in Baltimore City and being more fully described in a Mortgage dated March 15, 2004, and recorded among the Land Records of Baltimore City in Liber 5348 Folio 328 and more fully described as follows:

       BEGINNING at the corner formed by the intersection of the northwest side of Montpelier Street (formerly Madison Street) with the northwest side of Independence Street and running thence northwesterly binding on the northeast side of Montpelier Street 21 feet and 2 inches to a point which would intersect the continuance of a line drawn southwesterly to and through the center to a partition wall between the house on the lot now being described and the house adjoining thereto on the northwest thereof and thence northeasterly along said line and to and through the center of said partition wall and continuing the same course in all 101 feet and 6 inches more or less to the center of an alley 10 feet wide there situate, thence southeasterly binding along the center of said alley with the use of the same in common 21 feet and 2 inches to the northwest side of Independence Street and thence southwesterly along the northwest side of Independence Street 101 feet and nine inches more or less to the place of beginning. The improvements thereon being known as 948 Montpelier Street.

       The property is reported to be improved by a 3 story brick townhome containing living room, dining room and kitchen on the 1st floor; living room, 2 bedrooms and kitchen on the 2nd floor; kitchen, 2 bedrooms and bath on the 3rd floor. Basement with exit. Gas heat. Subject to an annual $90.00 ground rent.

       TERMS OF SALE: A deposit by certified check or cashier's check of $2,500 will be required of the purchaser at time and place of sale. Deposit to be increased to 10% of the purchase price within 24 hours at the offices of the Auctioneer. Balance to be paid in cash at settlement, which shall take place within ten (10) business days following final ratification of the sale by the Circuit Court for Baltimore City at the offices of the Trustee. If payment of the balance does not take place within the specified time, the deposit shall be forfeited and the property may be resold at the risk and expense of the purchaser. Interest to be charged on the unpaid purchase money, at the rate of 12% per annum from date of sale to date of settlement. All adjustments as of date of sale. Taxes, ground rent, and all other public charges and assessments payable on an annual basis, including sanitary and/or metropolitan district charges, if any, to be adjusted for the current year to date of sale and assumed thereafter by the purchaser. The property will be sold in "AS IS" condition, without express or implied warranty as to the nature and description of the improvements as contained herein; and subject to easements, agreements, restrictions or covenants of record affecting same, if any. Purchaser shall be responsible for obtaining physical possession of the property. If the Trustee is unable to convey good and marketable title, the purchaser's sole remedy in law or equity shall be limited to the refund of the deposit. Upon refund of the deposit this sale shall be null and void and of no effect, and the purchaser shall have no further claim against the Trustee, Mortgage Holder, or Auctioneer. Cost of all documentary stamps and transfer taxes to be paid by the purchaser. Time shall be of the essence for the purchaser. Risk of loss on the purchaser from date of sale.
