       Under and by virtue of a power of sale contained in a Deed of Trust and Security Agreement dated October 25, 2002 and recorded in the Clerk's Office of the Circuit Court for Baltimore City, Maryland in Liber 3016, at folio 167 (the "Deed of Trust") the undersigned Trustees, at the request of the beneficiary of the Deed of Trust (the "Beneficiary"), will sell at Public Auction the following:

       ALL THAT FEE SIMPLE PARCEL OF GROUND known as 2431 E. Oliver Street situate and lying in Baltimore City, and being more fully described in the Deed of Trust (the "Property").

       The Property is improved by 3-interconnecting townhomes that have been completely renovated and used as a funeral home. The building features recently installed carpeting; freshly painted drywall and plaster walls, gas hot water heater with newly installed gas boiler, central air conditioning, double glazed replacement windows and more. The building contains three interconnecting chapel rooms and 2 rest rooms, on the first floor; living quarters, offices and 3 full bathrooms, on the second floor; full basement with electric casket lift to the second floor. Lot size: 42' x 70', more or less. The Property is zoned R-8, residential with a non-conforming use as a funeral home (according the Baltimore City Office of Planning and Zoning).

       In addition, pursuant to its rights as a secured creditor, the Beneficiary will sell at public auction all equipment ("Equipment") which is the property of the owner of the Property, and which is located at the Property. EQUIPMENT: Large quantity of chairs, embalming table, stainless steel pot sink, etc. (To be sold as an entirety only)

       TERMS OF SALE: Cash. The Property will be offered for sale "AS IS, WHERE IS" and will be conveyed by Trustees' Deed subject to all encumbrances, rights, reservations, covenants, conditions, easements, restrictions and statutory liens, if any, having priority over the Deed of Trust, as they may lawfully affect the Property. All descriptions of the improvements have been obtained from material believed to be accurate, but no warranty is made, either express or implied, as to the accuracy of the representations.

       The Equipment will be offered for sale "AS IS, WHERE IS" and will be conveyed by a quitclaim bill of sale. Cash or certified funds at the time of sale and immediate removal required.

       The Property will first be offered for sale. The Equipment will then be offered for sale. At the conclusion of the bidding for the Property and the Equipment individually, the Property and the Equipment will be offered for sale together. At the conclusion of the bidding, the Trustees and the Beneficiary shall determine which bids to accept as the high bid or bids, and shall announce their decisions to the bidders.

       A deposit by certified check or cashier's check of Fifteen Thousand Dollars ($15,000) will be required of the purchaser at time and place of sale. The deposit shall be increased to 10% of the purchase price within 24 hours at the Auctioneer's Office. Balance to be paid in cash at settlement, which shall take place within ten (10) business days following final ratification of the sale by the Circuit Court for Baltimore City at the offices of the Trustee. If payment of the balance does not take place within the specified time, the deposit shall be forfeited and the property may be resold at the risk and expense of the purchaser. Interest to be charged on the unpaid purchase money, at the rate of 12.25% per annum from date of sale to date of settlement. All adjustments as of date of sale. Taxes, and all other public charges and assessments payable on an annual basis, including sanitary and/or metropolitan district charges, if any, to be adjusted for the current year to date of sale and assumed thereafter by the purchaser. Purchaser shall be responsible for obtaining physical possession of the Property. If the Trustee is unable to convey good and marketable title, the purchaser's sole remedy in law or equity shall be limited to the refund of the deposit. Upon a refund of the deposit the sale shall be null and void and of no effect and the purchaser shall have no further claim against the Trustees, Beneficiary, or Auctioneer. The purchaser shall pay all settlement fees, title examination charges, title charges and title insurance premiums, all recording costs (including the state grantor's tax and all state and county recordation fees, clerk's filing fees and transfer fees and taxes) and reasonable attorneys' fees and disbursements incurred in the preparation of the deed of conveyance and other settlement documentation. Time shall be of the essence for the purchaser. Risk of loss on the purchaser from date of sale. Additional terms and conditions may be announced at the time of sale.
