       Under and by virtue of the power of sale contained in a certain Indemnity Deed of Trust from Kapman Enterprises, LLC to the Trustees therein, dated March 30, 2005, and recorded among the Land Records of Baltimore County, Maryland, in Liber 25569, folio 462, and subsequently modified and amended, the holder of the indebtedness secured thereby having appointed Steven M.        BEING KNOWN AND DESIGNATED as Lots No. 1 through 20, the Drainage and Utility Reservation for flood plain containing 1.876 acres, Storm Water Management and Drainage Reservation area containing 0.255 acres, the bed of Ridge Park Court and MD Route 7, all as shown on the Plat entitled "Ridge Park," which plat is recorded among the Land Records of Baltimore County in Plat Book EHK, Jr. No. 44, folio 79; containing 6.897 acres.

       The site is also known as Parcel 280, Grid 1 on Baltimore County Tax Map 90. The property is situated along the north side of Philadelphia Road, east of Rossville Boulevard and west of Lennings Lane/Mayflower Road.        BEING KNOWN AND DESIGNATED as Lots Nos. 12, 16 and 18 as laid out and shown on the Plat of the "Middle River Garden Farms," which plat accompanied the deed from the Garden Farms Company to Henry D. Volz and recorded on March 16, 1917, among the Plat Records of Baltimore County in Plat Book W.P.C. No. 6, folio 96.

       The lots are also known as Lots 12, 16 and 18, Parcel 558 on Baltimore County Tax Map 90, which are located in Grid 1 of Tax Map. 91. The lots are wooded. Public water and sanitary sewer are in the area, but are not at the property. The three lots are not contiguous.

       Lot 12 - comprises 6.5 acres, fronting on the southwest side of Bengies Road.

       Manner of Sale - Each lot will be offered individually and the bid reserved. Then, all three lots will be offered as an entirety. The sale will be made in the manner producing the greater amount.

       Deposit - $10,000 on each lot or $30,000 as an entirety.


       Prospective purchasers are strongly encouraged to perform their own due diligence regarding the permitted uses of the properties, including zoning restrictions, utility availability and municipal requirements, if any. Acreage quantities mentioned within this advertisement are approximate and more or less.


       Deposits as stated above, payable by certified check or cashier's check, will be required of the purchaser at time and place of sale. The deposit shall be increased to 10% of the purchase price within 24 hours at the Auctioneer's Office. The holder of the indebtedness, if a bidder at the sale, shall not be required to post a deposit. Balance to be paid in cash at settlement, which shall take place within ten (10) business days following final ratification of the sale by the Circuit Court for Baltimore County at the offices of Rosenberg Martin Greenberg, LLP. If payment of the balance does not take place within the specified time, the deposit shall be forfeited and the property may be resold at the risk and expense of the purchaser. Interest to be charged on the unpaid purchase money, at the rate of 12% per annum, from date of sale to date of settlement. All adjustments as of date of sale. Taxes and all other public charges and assessments payable on an annual basis, including sanitary and/or metropolitan district charges, if any, to be adjusted for the current year to date of sale and assumed thereafter by the purchaser. The property will be sold in "AS IS" condition, without express or implied warranty as to the nature and description as contained herein; and subject to easements, agreements, restrictions or covenants of record affecting same, if any. Purchaser shall be responsible for obtaining physical possession of the property and assumes the risk of loss or damage to the property from the date of sale forward. The purchaser waives and releases the Substitute Trustees, their Attorneys, the holder of the indebtedness, the Auctioneers, and their respective agents, successors and assigns from any and all claims the purchaser and/or its successors and assigns may now have or may have in the future relating to the condition of the property, including but not limited to the environmental condition thereof. If the Substitute Trustees are unable to convey good and marketable title, the purchaser's sole remedy in law or equity shall be limited to the refund of the deposit. Upon refund of the deposit this sale shall be null and void and of no effect, and the purchaser shall have no further claim against the Substitute Trustees, their Attorneys, the holder of the indebtedness or Auctioneers. Recordation costs, transfer taxes and all other costs incident to settlement, including a $300 document review fee by the Seller's attorney, to be paid by the purchaser. Time shall be of the essence for the purchaser.
