        Under and by virtue of the power of sale contained in a certain Deed of Trust from Progressive Baptist Church, Inc. to the Trustees therein, dated July 13, 2004, and recorded among the Land Records of Prince George's County, Maryland, in Liber No. 19949, Folio 595, the holder of the indebtedness secured thereby having appointed the undersigned to act as Substitute Trustees, in place and stead of the aforementioned Trustees, default having occurred under the terms thereof and pursuant to the provisions contained in the Deed of Trust granting to the Beneficiary the rights of a secured creditor under the provisions of the Maryland Uniform Commercial Code as perfected under a financing statement recorded among the land records aforesaid at Liber No 19949, folio 619 and at the request of the party secured thereby, the undersigned Substitute Trustees will sell at Public Auction by virtue of proceedings before The Circuit Court For Prince George's County and captioned as Robert S. Glushakow, Douglas L. Burgess, Substitute Trustees vs. Progressive Baptist Church, Inc., Case No. CAE 09-10764 on the premises:


        All that fee simple parcel of ground and improvements thereon situate and lying in Prince George's County, State of Maryland, being more fully described in the above-referenced Deed of Trust which legal description is incorporated by reference herein and having an address 5404, 5406, 5408 and 5410 Brinkley Road, Temple Hills, Maryland 20748.


        The property is an irregular configuration, fronting approximately 167' along the north side of Brinkley Road and comprising 11.66 acres of land, more or less. The site is shown on Prince George's County Tax Map No. 98, Grid A4 as Parcels 3587, 65 and A. Parcel 3587 comprises the church. Parcel 65 a large asphalt paved parking lot and Parcel A, the school, gymnasium, two story home, playing fields and additional parking area.

        The property will be sold in AS-IS, WHERE-IS condition and title to the property is subject to covenants, conditions, restrictions, and agreements of record affecting the same, with no warranty of any kind, express or implied. Prospective purchasers are encouraged to perform their own due diligence, in advance of the auction, regarding the zoning classification and the permitted uses of the property.


TERMS OF SALE


        A $100,000 deposit, payable by certified check or cashier's check, will be required of the purchaser at time and place of sale. The deposit is to be increased to ten percent (10%) of the purchase price within twenty-four (24) hours at the office of the auctioneers. No deposit will be required of the Deed of Trust Beneficiary or Noteholder or its wholly owned subsidiary if the property is purchased by the Deed of Trust Beneficiary or Noteholder or its wholly owned subsidiary. Balance to be paid in cash at settlement, which shall take place within ten (10) business days following final ratification of the sale by the Circuit Court for Prince George's County. TIME IS OF THE ESSENCE FOR THE PURCHASER. If payment of the balance does not take place within the specified time, the deposit shall be forfeited, the property will be resold at the risk and expense of the defaulting purchaser, and the defaulting purchaser shall be required to pay a reasonable fee of not less than $1,000.00 as a payment for fees and costs associated with the procedures giving rise to the re-sale of the property. The Deed of Trust Beneficiary and/or the Noteholder shall be entitled to all excess proceeds under a resale of the property. Interest to be charged on the unpaid purchase money, at the rate stated in the Note executed in connection with the Deed of Trust filed in the foreclosure proceedings, from date of sale to date of settlement. All adjustments as of date of sale. Taxes and all other public charges and assessments for the current year, including sanitary and/or metropolitan district charges, if any, to be adjusted for the current year to date of sale and assumed thereafter by the purchaser. All costs incident to the settlement shall be paid by the purchaser with all costs of documentary stamps, transfer taxes and recording charges to be paid by the purchaser. The Substitute Trustees, the Deed of Trust Beneficiary nor the Noteholder shall pay any costs of any kind for closing the transaction. All costs are borne by the purchaser. The property will be sold in "AS IS WHERE-IS" condition, without express or implied warranty as to the nature, condition and/or description of the improvements, the ability of the property to be further developed or subdivided, the ability of the improvements to be maintained as separate rental units, the ability of the property to be divided into a residential subdivision, the ability of the existing improvements to serve as rental units, the value, profitability or income potential of the property, the ability of the property to obtain or maintain multiple family dwelling permits, the existence or non-existence of lead paint or any existent or latent environmental condition affecting the property and the improvements. The sale shall be subject to any housing code violations, easements, agreements, tenancies, restrictions and/or covenants of record affecting same, if any and the property is subject to the rights of redemption of the Internal Revenue Service. Conveyance shall be by Substitute Trustees' Deed without covenant or warranty, express or implied. The purchaser shall be responsible for complying with the registration of the property with those governmental entities having jurisdiction over the property, if applicable. If settlement is delayed for any reason, there will be no abatement of interest. This Advertisement may be amended or supplemented by oral announcements during the conduct of the sale, and any such announcements shall constitute further terms or conditions upon which the above described property will be offered for sale. The Substitute Trustees may reject and withdraw a bid by a prospective bidding purchaser at sale, if the Substitute Trustees determine that any bid so offered is not commensurate with the value of the property being foreclosed upon. The highest bidder acknowledged by the Substitute Trustees shall be the Purchaser, and in the event of any dispute among the bidders, the Substitute Trustees shall have the sole and absolute final discretion to determine the successful bidder or to resell the property. Purchaser shall be responsible for obtaining physical possession of the property, and the risk of loss shall be assumed by the purchaser from the date of sale. If the Substitute Trustees are unable to convey good and marketable fee simple title, the purchaser's sole remedy in law or equity shall be limited to the refund of the deposit. Upon refund of the deposit, this sale shall be null and void and of no effect, and the purchaser shall have no further claim against the Substitute Trustees, the Deed of Trust Beneficiary, the Noteholder, the Solicitors or Auctioneer. The right to postpone, set over, or cancel the sale prior to the scheduled sale is reserved by the Substitute Trustees. Any such postponement, setting over, or cancellation will be announced on the scheduled date of sale.


        BROKER PARTICIPATION IS INVITED: The Deed of Trust Beneficiary will pay any licensed Maryland real estate broker, in cooperation with A. J. Billig & Co., Auctioneers the exclusive listing agent a one percent (1%) commission based upon the gross selling price of the above-described property, if purchased by their registered client. The payment of the aforementioned commission is expressly conditioned upon the consummation of closing for the sale and purchase of the subject property and all sales proceeds being received and available for immediate distribution to the Substitute Trustees. Participating brokers (either directly or through their duly licensed and authorized sales agent) must make the initial contact with the Auctioneers on behalf of their client and enroll their potential purchaser with A. J. Billig & Company prior to 5:00 P.M., no later than one day before the sale of September 22, 2009. Both the broker and the purchaser must attend the auction. Proof of licensure will be required. The cooperation fee will be paid by the Deed of Trust Beneficiary upon settlement by the purchaser. No broker will be recognized as representing a principal who has been in direct contact with A. J. Billig & Co., nor will any commission be paid by the Deed of Trust Beneficiary to any broker who is a partner, stockholder, member, principal or affiliate of any entity purchasing the property.
