        Under and by virtue of the power of sale contained in a certain Indemnity Deed of Trust from Bunnie Dean Pitts to the Trustee therein, dated March 28, 2005, and recorded among the Land Records of Somerset County, in Liber 600, Page 132, the holder of the indebtedness secured thereby having appointed Brett A. Solomon and Robert B. Greenwalt to act as Substitute Trustees, in place and stead of the aforementioned Trustee, by instrument duly executed, acknowledged and recorded among the Land Records aforesaid, default having occurred under the terms thereof and at the request of the party secured thereby, the undersigned Substitute Trustees will sell at Public Auction, at the Somerset County Circuit Courthouse Steps, the following:


        All that fee simple lot or parcel of land situate, lying and being in Lawsons Election District, Somerset County, State of Maryland, and more particularly described as follows:


        All that lot or parcel of land situate, as aforesaid, located on the Westerly side of and binding upon Maryland Route 667; beginning for the same on the Westerly side of Maryland Route 667 and the Southerly side of Crackertown Road, at a point being the Northeast corner of the lot hereby conveyed; thence South 30° 00' 00" West, a distance of 382.15 feet; thence North 61° 01' 49" West, a distance of 492.25 feet; thence North 60° 07' 19" West, a distance of 13.98 feet; thence North 15° 52' 28" East, a distance of 159.08 feet; thence North 11° 40' 45" East, a distance of 102.33 feet; thence North 10° 45' 45" East, a distance of 133.16 feet; thence South 58° 43' 32" East, a distance of 173.89 feet; thence South 61° 17' 38" East, a distance of 303.94 feet; thence South 64° 16' 59" East, a distance of 146.72 feet to the place of beginning.  The land hereby conveyed contains approximately 4.833 acres of land, more or less; AND BEING ALL AND THE SAME property that was conveyed unto Julius W. Thompson by John E. Schultz, Sr. and Timothy C. Carson, partners trading as T & J Partnership, by Deed dated November 18, 1998 and recorded among the Land Records of Somerset County, Maryland in Liber No. 469, folio 955, et seq.; and being the same and all that property conveyed unto Bunnie Dean Pitts from Julius W. Thompson by deed dated January 4, 2000 and recorded among the aforesaid Land Records in Liber I.T.P.  No. 491, folio 227.


        The property is believed to be unimproved.  According to public tax records, the site is zoned R2, residential.  Public water and sewer may be available.


        TERMS OF SALE:  A $2,500 deposit, payable by certified check or cashier's check, will be required of the purchaser at time and place of sale.  The deposit shall be increased to 10% of the purchase price by 12 noon on Monday, December 7, 2009 at the Auctioneer's office.  The holder of the indebtedness, if a bidder at the sale, shall not be required to post a deposit. Balance to be paid in cash at settlement, which shall take place within ten (10) business days following final ratification of the sale by the Circuit Court for Somerset County at a location designated by the Substitute Trustees.  If payment of the balance does not take place within the specified time, the deposit shall be forfeited and the property may be resold at the risk and expense of the purchaser.  Interest to be charged on the unpaid purchase money, at the rate stated in the Note executed in connection with the foreclosed Indemnity Deed of Trust, from date of sale to date of settlement.  If settlement is delayed for any reason, there will be no abatement of interest.  All adjustments as of date of sale.  Taxes and all other public charges and assessments payable on an annual basis, including sanitary and/or metropolitan district charges, if any, to be adjusted for the current year to date of sale and assumed thereafter by the purchaser.  The property will be sold in "AS IS" condition, without express or implied warranty as to the nature and description of the improvements as contained herein;  and subject to easements, agreements, restrictions or covenants of record affecting same, if any.  Purchaser shall be responsible for obtaining physical possession of the property and assumes the risk of loss or damage to the property from the date of sale forward.  The purchaser waives and releases the Substitute Trustees, the holder of the indebtedness, the Auctioneers, and their respective agents, successors and assigns from any and all claims the purchaser and/or its successors and assigns may now have or may have in the future relating to the condition of the property, including but not limited to the environmental condition thereof. If the Substitute Trustees are unable to convey good and marketable title, the purchaser's sole remedy in law or equity shall be limited to the refund of the deposit.  Upon refund of the deposit this sale shall be null and void and of no effect, and the purchaser shall have no further claim against the Substitute Trustees, the holder of the indebtedness or Auctioneers.  Recordation costs, transfer taxes and all other costs incident to settlement, including a $300 document review fee by the Seller's attorney, to be paid by the purchaser.  Time shall be of the essence for the purchaser.
