        Under and by virtue of the power of sale contained in a certain Indemnity Deed of Trust from Trump Investors, LLC to Sandra D. Feltman and Mary Beyer Halsey, Trustees, dated November 9, 2007, and recorded among the Land Records of Howard County, Maryland, in Liber 11003, folio 063, default having occurred under the terms thereof and at the request of the party secured thereby, the undersigned Trustees will sell at Public Auction, on the premises, the following:

        All that fee simple lot of ground and the improvements thereon, situate and lying in Howard County, State of Maryland and being more fully described in the above-referenced Deed of Trust. A copy of the metes and bounds description may be obtained from the Auctioneers and is posted on the Auctioneers’ web site.

        The property is believed to comprise an unimproved lot, located on a private driveway serving 7940, 7942 and 7944 Harriet Tubman Lane. The auction property is located at end of the drive, adjacent on the south to 7940 Harriet Tubman Lane. Public records indicate the property is located in an R-20, residential zoning district. Private well and septic are believed to be required.

        The property is further described as follows:

Beginning for the same at a point in the right of way of Maryland Route 32, said point being on a 130.06 feet from the beginning of the first line of that land, the land herein being a part thereof, which by deed dated February 10, 1965 and recorded among the Land Records of Howard County, Maryland in Liber 434, folio 490, was granted and conveyed by William Thomas Bordley, Jr., Mary H. Dorsey, Laura I. Dorsey, Susie Dorsey Cole and Raymond Cole, her husband to Addie Virginia Holland, thence running with said Maryland Route 32 and part of said first line as now surveyed;

(1) North 89 degrees 56 minutes 06 seconds East, 5.00 feet to a point, thence leaving said road and running with all of the second line of the above mentioned conveyance, passing over a pipe found at the end thereof and continuing 54.29 feet, thence,

(2) South 00 degrees 43 minutes 46 seconds East, 402.77 feet to a pipe set, thence,

(3) South 17 degrees 57 minutes 18 seconds West, 252.37 feet to a pipe set, thence,

(4) South 72 degrees 02 minutes 42 seconds East, 217.13 feet to a pipe set on and 165.03 feet from the beginning of the third or North 2 degrees West, 12 and 6/10 perches line of that land described in the second part of a deed from Laura Irene Dorsey and Susie Estella Cole to Laura Irene Dorsey, Susie Estella Cole, Laura Virginia Makle and William T. Dorsey, recorded in the land records of Howard County, Maryland in Liber 622 folio 458 and running reversely with said line as now surveyed,

(5) South 00 degrees 37 minutes 18 seconds East, 165.03 feet to a stone found on and 421.49 feet from the end of the seventh line of the first above mentioned land, thence running with part of the seventh line as now surveyed.

(6) North 74 degrees 12 minutes 43 seconds West, 274.90 feet to a pipe set, thence leaving said outline for the following two courses,

(7) North 17 degrees 57 minutes 18 seconds East, 418.38 feet to a pipe set, thence,

(8) North 00 degrees 43 minutes 46 seconds West, 402.01 feet to the point of beginning and containing 1.00 acres of land, more or less.

Subject to and in benefit of however, a 15 foot wide easement for ingress and egress, the centerline of which is described as follows;

Beginning for the centerline at a point in the right of way of Maryland Route 32, said point being on and 127.56 feet from the beginning of the first line of the above mentioned conveyance to Addie V. Holland and running thence,

(1) South 00 degrees 43 minutes 46 seconds East, 401.62 feet to a point, thence,

(2) South 17 degrees 57 minutes 18 seconds West, 255.00 feet to the end of said easement.

        TERMS OF SALE: A $10,000 deposit, payable by certified check or cashier's check, will be required of the purchaser at time and place of sale. The deposit shall be increased to 10% of the purchase price within 24 hours at the Auctioneer’s Office. The holder of the indebtedness, if a bidder at the sale, shall not be required to post a deposit. Balance to be paid in cash at settlement, which shall take place within ten (10) business days following final ratification of the sale by the Circuit Court for Howard County at the offices of the Solicitor captioned above. If payment of the balance does not take place within the specified time, the deposit shall be forfeited and the property may be resold at the risk and expense of the purchaser. Interest to be charged on the unpaid purchase money, at the rate stated in the Note executed in connection with the foreclosed Indemnity Deed of Trust, from date of sale to date of settlement. If settlement is delayed for any reason, there will be no abatement of interest. All adjustments as of date of sale. Taxes and all other public charges and assessments payable on an annual basis, including sanitary and/or metropolitan district charges, if any, to be adjusted for the current year to date of sale and assumed thereafter by the purchaser. The property will be sold in "AS IS" condition, without express or implied warranty as to the nature and description of the improvements as contained herein; and subject to easements, agreements, restrictions or covenants of record affecting same, if any. Purchaser shall be responsible for obtaining physical possession of the property and assumes the risk of loss or damage to the property from the date of sale forward. The purchaser waives and releases the Trustees, the holder of the indebtedness, the Auctioneers, and their respective agents, successors and assigns from any and all claims the purchaser and/or its successors and assigns may now have or may have in the future relating to the condition of the property, including but not limited to the environmental condition thereof. If the Trustees are unable to convey good and marketable title, the purchaser's sole remedy in law or equity shall be limited to the refund of the deposit. Upon refund of the deposit this sale shall be null and void and of no effect, and the purchaser shall have no further claim against the Trustees, the holder of the indebtedness or Auctioneers. State and local recordation and transfer taxes and all other costs incident to settlement, including a $300 document review fee by the Seller’s attorney, to be paid by the purchaser. Time shall be of the essence for the purchaser.
