        Pursuant to an Order of the United States Bankruptcy Court for the District of Maryland passed in the matter of North Linthicum Recreation Club, Inc., Debtor, Case No. 09-21104-JS (Chapter 7), the undersigned Trustee will sell at public auction to the highest bidder above $30,000, the following:

        All that fee simple lot of ground and the improvements thereon, situate and lying in Anne Arundel County, State of Maryland and being more fully described in the Deed to the above-named Debtor, dated November 29, 1973 and recorded among the Land Records of Anne Arundel County in Liber 2641, page 600; comprising 1.98 acres of land.  According to public tax records, the property is located in an R5, residential zoning district.

        The lot consists of a rectangular parcel, approximately 287' x 300', situated along a roadway and parking area in Harold Dorness Overlook Park (Anne Arundel County Department of Recreation and Parks).  The parcel is chain link fenced and improved as follows:

  • L-shaped inground swimming pool, approximately 35' x 83' with 23' x 20' extension, depths from 3' to 8.5', concrete decking

        TERMS OF SALE:  A $5,000 deposit, payable by certified check or cashier's check, will be required of the Purchaser at time and place of sale. The deposit shall be increased to 10% of the purchase price within 24 hours at the Auctioneer’s office. Balance to be paid in cash within 30 days unless extended in writing by the Trustee in his sole and absolute discretion. If payment of the balance does not take place within the specified time, in addition to any other legal or equitable remedies available, the deposit shall be forfeited and the property may be resold at the risk and expense of the Purchaser. Interest to be charged on the unpaid purchase money, at the rate of 12% per annum, from date of sale to date of settlement. All adjustments, including taxes, all other public and private charges and assessments payable on an annual basis, and sanitary and/or metropolitan district charges, if any owed against the property shall be borne by the purchaser and paid for by the purchaser at or before settlement, with the sole exception of the outstanding Anne Arundel County real property taxes relating to the tax sale lien sold to ETS Maryland, LLC which shall be redeemed from the proceeds of the sale on or before closing. Such tax lien does not include any real property taxes due and payable for the 2009-2010 tax year which, as set forth above, are the sole responsibility of the purchaser. The property will be sold in "AS IS" condition, without any recourse, representations or warranties, expressed or implied, as to its nature, condition, value, use or description and subject to easements, agreements, restrictions or covenants of record affecting same, if any, that are not extinguished by operation of law by the sale. Purchaser assumes the risk of loss from the date of sale forward. The Purchaser waives and releases the Seller, the Auctioneers, and their respective agents, successors and assigns from any and all claims the Purchaser and/or its successors and assigns may now have or may have in the future relating to the condition of the property, including but not limited to the environmental condition thereof. If the Seller is unable to convey title, the Purchaser's sole remedy in law or equity shall be limited to the refund of the deposit. Upon refund of the deposit this sale shall be null and void and of no effect, and the Purchaser shall have no further claim against the Trustee, the Debtor’s estate or Auctioneers. The conveyance to the purchaser at settlement shall be Trustee’s Deed without covenant, warranty or representation. Recordation costs, transfer taxes and all costs incidental to settlement to be paid by the Purchaser. Time is of the essence.
